These Terms and Conditions govern the use of the iPhone app UWGrade and the UWGrade Pro subscription.
1. Provider and scope

You download UWGrade from Apple's App Store. The license to use the app is governed by Apple's Licensed Application End User License Agreement (EULA). These Terms supplement it. Purchase, payment and billing are additionally governed by Apple's Media Services Terms and Conditions.
2. What the app provides
UWGrade corrects the colors of underwater photos and videos, captures photos and videos with live correction and exports the results. Editing happens on your iPhone.
You can use all features for free. Without an active subscription, the app adds a watermark to captures, edits and exports: large “UWGrade” lettering in the lower-right corner and a subtle “UWGrade” pattern across the whole image.
You don't need a user account. We strive for an error-free app, but we can't guarantee a particular look or uninterrupted availability. We keep developing the app and may change features where this is reasonable for you.
3. UWGrade Pro subscription
- What you get: While your subscription is active, UWGrade adds no watermark to new captures, edits and exports. After the purchase, the app replaces photos and videos you took earlier with the UWGrade camera without a subscription with versions without the watermark, if you agree in Photos.
- Prices: €3.99 per month or €29.99 per year, each including VAT in Germany. In other countries, the price the App Store shows before purchase applies.
- Contract and payment: You buy the subscription in the App Store with your Apple Account. Apple charges the payment method on file with Apple as soon as you confirm the purchase.
- Renewal: The subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Cancellation: You cancel in UWGrade with “Manage Subscription” on the “UWGrade Pro” page, in your Apple Account settings under “Subscriptions” or at apps.apple.com/account/subscriptions. The subscription stays active until the end of the paid period. Deleting the app doesn't cancel the subscription.
- Price changes: Apple informs you about price changes in advance. For a price increase, Apple asks for your consent where required; without consent, the subscription ends at the end of the period.
4. End of the subscription
If your subscription ends through cancellation or expiry, UWGrade adds the watermark again to new captures, edits and exports from that point on. Results you saved without a watermark during the subscription stay unchanged.
5. Restoring purchases and offline use
On a new iPhone or after reinstalling, you restore your subscription like this: In the library, tap the “…” menu, then “Remove Watermark” and the button for restoring purchases. You must be signed in with the same Apple Account you used to buy the subscription.
Without an internet connection, a known subscription stays active until the end of the last confirmed period. After that, the app checks the status as soon as a connection is available again.
6. Right of withdrawal and refunds
Apple is the seller of the subscription under the purchase contract. A statutory right of withdrawal for consumers and refunds are therefore governed by Apple's terms. You request a refund from Apple at reportaproblem.apple.com. We can't refund payments ourselves because we don't receive any payments.
7. Your content
All rights to your photos and videos remain with you. We don't receive your content and claim no rights to use it.
At your request, UWGrade can apply a correction to the original in the Photos app or delete media. Keep important originals in an additional backup.
8. Use underwater
iPhones are not built for diving. Only use the camera underwater in a suitable, sealed underwater housing and follow its instructions. When diving and snorkeling, put your safety first.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For slight negligence, we are only liable if we breach an essential contractual obligation, that is, an obligation whose fulfillment makes using the app possible in the first place and on whose compliance you may rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.
To the extent permitted by law, we are not liable for water damage to your iPhone, for example due to a leaking housing.
10. Changes to these Terms
We may change these Terms if the app, the law or Apple's terms change. We inform you of material changes in good time in the app or on this page. For an active subscription, changes apply only from the next renewal period.
11. Governing law and dispute resolution
German law applies. If you are a consumer, you keep the protection of the mandatory provisions of the country where you have your habitual residence.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
